Increase in Intellectual Property Disputes: The Case of Technological Patents

Patent law has become a crucial area of business law, particularly due to new technologies. The French Intellectual Property Code (CPI) governs the protection of inventions in France, with Article L611-1 of the CPI defining the conditions required to obtain a patent. Technological companies must pay special attention to Articles L613-1 to L613-30 of the CPI, which regulate the filing process, patent acquisition, and defense. Additionally, Directive (EU) 2016/943 of the European Parliament on the protection of trade secrets was adopted to strengthen the fight against industrial espionage and the unauthorized disclosure of innovations. With the rise of patent disputes, particularly in technological sectors (smartphones, automotive, etc.), lawyers must be prepared to defend or challenge patents, keeping in mind the recent developments in litigation and out-of-court settlements.
